What is a Conditional Offer?A Conditional Offer gives you the opportunity to pay a Fixed Penalty of £60 and have your driving licence endorsed with 3 penalty points as an alternative to court proceedings. To comply with the offer, you must submit both your payment and driving licence and counterpart to any Scottish Court (A full list of courts can be found at www.scotcourts.gov.uk) within 28 days of the date of issue. What happens if I do not/cannot comply with the Conditional Offer?Failure to comply with the Conditional Offer within the specified period will result in the matter being referred to the Procurator Fiscal. Can I dispute this matter?You have the right to challenge this offence in court, if you do not comply with the Conditional Offer for any reason. The matter will be referred to the Procurator Fiscal. I cannot find my driving licence. What should I do?You should immediately apply to DVLA Swansea for a replacement/duplicate licence. (Application Forms can be obtained online or at some Post Offices). Remember that you need to produce a current driving licence whether the matter is dealt with by way of Conditional Offer or by the Procurator Fiscal. If the 28-day payment period has expired, the matter will be reported to the Procurator Fiscal, who will contact you in due course. The Conditional Offer period will not be extended. How long will the points remain on my licence?Penalty points awarded for a speeding offence are valid for a period of three years from the date of offence but cannot be removed from your licence until four years have elapsed. What should I do if my name/address details have changed but my driving licence has not yet been updated?To avoid exceeding the Conditional Offer time limit, you should initially send the driving licence to the Court together with your payment. You must advise the Court that you have changed address to enable the driving licence to be returned to the correct address. When you receive the licence back, you must send it to the DVLA to have the details changed. I sent my licence to the court weeks ago and have not received it back yet, how long does it take?You should contact the court which you sent your licence to and full contact details can be obtained from www.scotcourts.gov.uk |
